ന്യൂദല്ഹി: കഴിഞ്ഞ കുറെക്കാലമായി യൂട്യൂബിലും സമൂഹമാധ്യമങ്ങളിലും മോദിയെ പരിഹസിക്കാന് വേണ്ടി കറങ്ങി നടക്കുന്ന ഒരു വ്യാജ വീഡിയോ കണ്ടാണ് ജാന്മണി പ്രധാനമന്ത്രി മോദിയെയും അമ്മയേയും പരിഹസിച്ചത്. ആ യുട്യൂബ് വീഡിയോയില് മോദിയുടെ അച്ഛന് 1947ല് മരിച്ചുവെന്നാണ് പറയുന്നത്. അതേ സമയം മോദിയുടെ ജന്മവര്ഷം 1950 എന്നും കാണിച്ചിരിക്കുന്നു. ഇത് വ്യാജ വീഡിയോ ആണെന്ന് വിവിധ ഫാക്ട് ചെക്കിംഗ് വെബ്സൈറ്റുകള് തന്നെ സ്ഥിരീകരിച്ചിട്ടുമുണ്ട്.
“1947ല് അച്ഛന് മരിച്ചെങ്കില് എങ്ങിനെ 1950ല് മോദി ജനിക്കും എന്നാണ് ജാന്മണി ചോദിക്കുന്നത്. അവന് (മോദി) സ്വന്തം അച്ഛനെ ആദ്യം കണ്ടുപിടിക്കട്ടെ”- എന്നാണ് ഒരു യൂട്യൂബ് ചാനലിന് നല്കിയ അഭിമുഖത്തില് ജാന്മണി ചോദിക്കുന്നത്. ഇത് ജാന്മണി പറഞ്ഞത് വ്യാജ യൂട്യൂബ് വീഡിയോയുടെ അടിസ്ഥാനത്തിലാണ്. കഴിഞ്ഞ 12 വര്ഷമായി ഒരു രാജ്യം ഭരിയ്ക്കുന്ന പ്രധാനമന്ത്രിയെ അവന് എന്ന രീതിയില് അധിക്ഷേപിച്ചാണ് ജാന്മണി സംസാരിക്കുന്നത്. എന്താണ് മോദിയോട് ജാന്മണിയ്ക്ക് ഇത്ര പുച്ഛവും വിദ്വേഷവും എന്നും അറിയുന്നില്ല.
എന്നാല് നരേന്ദ്രമോദിയുടെ അച്ഛന് ദാമോദര് ദാസ് മൂല്ചന്ദ് മോദി മരിച്ചത് 1989ല് ആണെന്നതാണ് വാസ്തവം. നരേന്ദ്രമോദിയുടെ മൂത്ത് ജ്യേഷ്ഠന് സോമ മോദി, ഇളയ സഹോദരന് പ്രഹ്ളാദ് മോദി എന്നിവര് നരേന്ദ്രമോദിയുടെ മരണം സ്ഥിരീകരിച്ചിട്ടുണ്ട്. എല്ലിലെ ക്യാന്സര് ആയിരുന്നു അച്ഛന്റെ മരണ കാരണം. അന്ന് ആര്എസ്എസ് പ്രചാരക് ആയിരുന്നു നരേന്ദ്രമോദി. ഇക്കാര്യങ്ങള് ബിജെപി വിരുദ്ധ ഫാക്ട് ചെക്കിംഗ് വെബ്സൈറ്റായ ആള്ട് ന്യൂസും സ്ഥിരീകരിക്കുന്നു.
മോദിയുടെ അച്ഛന് 1947ല് മരിച്ചുവെന്ന് അവകാശപ്പെടുന്ന വ്യാജവീഡിയോയില് മറ്റൊരു കല്ലുവെച്ച നുണയും പറയുന്നുണ്ട്. നരേന്ദ്രമോദി തന്റെ മന്കീ ബാത്ത് പരിപാടിയില് അച്ഛന് ജയിലില് വെച്ച് 1947ല് മരിച്ചുവെന്നാണ് പറഞ്ഞിരിക്കുന്നതെന്നും ഈ വീഡിയോയില് പറയുന്നു. ഇതും തെറ്റായ പ്രചാരണമാണ്. മോദി തന്നെ തന്റെ പല പ്രസംഗങ്ങളിലും അച്ഛന് 1989ല് മരിച്ചതായി സൂചിപ്പിച്ചിട്ടുണ്ട്. നിലഞ്ജന് മുഖോപാധ്യായ രചിച്ച നരേന്ദ്ര മോദി, ദ മാന്, ദ ടൈംസ് എന്ന ജീവചരിത്ര പുസ്തകത്തില് നരേന്ദ്രമോദി തന്നെ അച്ഛന്റെ മരണത്തെക്കുറിച്ച് സൂചിപ്പിച്ചിട്ടുണ്ട്. അച്ഛന് മരിക്കുന്നതിന് തൊട്ടുമുന്പ് വീട്ടിലെത്തിയ താന് അച്ഛന് മാനസരോവറിലെ പുണ്യജലം കുടിക്കാന് നല്കിയതായും മോദി ഈ പുസ്തകത്തില് പറയുന്നു. 1967ല് വീട് വിട്ട വ്യക്തിയാണ് മോദി. അച്ഛന്റെ രോഗവിവരം അറിഞ്ഞതിനെ തുടര്ന്നാണ് അന്ന് കൈലാസ് മാനസരോവര് യാത്രയിലായിരുന്ന മോദി വീട്ടില് എത്തി അച്ഛനെ കാണുന്നത്. അച്ഛന് 1989ല് മരിച്ചുവെന്ന് മോദി പറഞ്ഞതായും ഈ ജീവചരിത്ര പുസ്തകത്തില് പറയുന്നു.
വാസ്തവത്തില് യാതൊരു അടിസ്ഥാനവുമില്ലാത്ത ഒരു വ്യാജ യൂട്യുബ് വീഡിയോ കണ്ട് മോദിയുടെ പിറവിയെ അപഹസിക്കുക വഴി മോദിയുടെ പാവം അമ്മയെയുമാണ് ജാന്മണി പരിഹസിച്ചത്. ഹീരാബെന് എന്നാണ് മോദിയുടെ അമ്മയുടെ പേര്. ഒരു പാട് കഷ്ടപ്പാടുകളിലൂടെ മക്കളെ വളര്ത്തിയവരായിരുന്നു മോദിയുടെ അമ്മ. മോദി ജനിച്ചത് മറ്റു പിന്നാക്ക വിഭാഗത്തില് (ഒബിസി) ആണ്.
ജാന്മണിയ്ക്കെതിരെ വിവിധ പൊലീസ് സ്റ്റേഷനുകളില് കേസ് നല്കാന് അഭിഭാഷകന് കൂടിയായ ശങ്കു ടി ദാസ് ഒരു പരാതി തയ്യാറാക്കിയിട്ടുണ്ട്. ജാന്മണി നടത്തിയത് ഗുരുതരമായ അധിക്ഷേപമാണെന്നും ഇതിന് ഭാരതീയ ന്യായസംഹിത 2023, ഭാരതീയ നാഗരിക് സുരക്ഷ സംഹിത 2023, ഇന്ഫര്മേഷന് ടെക്നോളജി ആക്ട് 2000, മറ്റ് നിയമങ്ങള് എന്നിവ പ്രകാരം കേസെടുക്കാനാകുമെന്നും ശങ്കു ടി ദാസ് പറയുന്നു.
ഈ പരാതി വിവിധ പൊലീസ് സ്റ്റേഷനുകളില് സമര്പ്പിക്കാന് യുവബിജെപി നേതാവ് യുവരാജ് ഗോകുള് ആഹ്വാനം ചെയ്യുകയും അദ്ദേഹത്തിന്റെ ഫെയ്സ്ബുക്ക് പേജില് പങ്കുവെയ്ക്കുകയും ചെയ്തിട്ടുണ്ട്.

Subject: Complaint seeking urgent legal action against the person who published and circulated a social media video containing highly derogatory, insulting and allegedly defamatory remarks against the Hon’ble Prime Minister of India, Shri Narendra Modi, and derogatory personal allegations against his deceased mother
Respected Sir/Madam,
I, (Your Name) , hereby submit this complaint seeking urgent legal action against the person identified as Janmoni [full name and other identifying details, if available], who is stated to be a celebrity makeup artist and social media influencer, in connection with a video circulated through social media platforms, including Facebook.
I have come across the said video, a copy/link of which is being submitted along with this complaint as evidence. In the said video, the person concerned is seen and heard making extremely derogatory, insulting and objectionable statements against the Hon’ble Prime Minister of India, Shri Narendra Modi, and making deeply offensive and disparaging personal allegations against his deceased mother.
The statements made in the video, as understood from the contents thereof, include references to the death of the Hon’ble Prime Minister’s father and to the year of birth of Shri Narendra Modi, followed by an insinuation that his mother had supposedly carried him in her womb for an abnormally long period after the death of his father. The said statement is not made as a mere political criticism or as a legitimate expression of dissent. Rather, it is presented in a manner intended to cast aspersions upon the character and personal dignity of a deceased woman who is no longer alive to defend herself.
The video also contains several extremely vulgar, humiliating and personally abusive expressions directed against the Hon’ble Prime Minister, including derogatory references to his intelligence, physical condition and personal habits. The overall tenor and manner of the video, in my respectful submission, goes far beyond legitimate political criticism or the exercise of the right to freedom of speech and expression. It appears to be a deliberate attempt to humiliate and demean a person holding the highest elected executive office of the country and, at the same time, to outrage the dignity and memory of his deceased mother through wholly scandalous and personally degrading allegations.
I submit that criticism of any public figure, including the Prime Minister of India, is undoubtedly permissible in a democracy. However, the right to freedom of speech and expression cannot be understood as an unrestricted licence to make malicious, scandalous and defamatory imputations concerning the private character of individuals or to deliberately circulate false and degrading allegations through social media.
The publication and circulation of such content on a public social media platform have the potential to reach a very large audience and cause widespread humiliation, reputational harm and public disorder. The fact that the statements concern not merely political policies or public conduct but also contain personal and indecent allegations against the family and deceased mother of a constitutional functionary makes the matter particularly serious.
I am making this complaint not merely as a supporter of any political party, but as a citizen of India who believes that democratic criticism must remain within the bounds of law, civility and constitutional responsibility. I strongly believe that every citizen has the right to criticise the Government and political leaders, but such criticism should not degenerate into deliberate personal vilification, character assassination and the circulation of potentially false and defamatory allegations.
The contents of the said video, prima facie, warrant an investigation as to whether the maker and/or publisher has committed offences punishable under the applicable provisions of the Bharatiya Nyaya Sanhita, 2023, including, as may be attracted on the basis of the exact words used, the provisions relating to intentional insult with intent to provoke breach of peace under Section 352, statements conducing to public mischief under Section 353, and defamation under Section 356, apart from any other provision of law including Information Technology Act, 2000 that may be attracted upon investigation. The applicability of each provision may kindly be determined by the Investigating Officer based on the exact contents, context, intention and manner of publication and circulation of the video.
I further submit that, if the investigation reveals that the publication was made with any additional intention to create public alarm, provoke hostility, disturb public tranquillity, or promote hatred or ill-will between groups or communities, appropriate provisions of law may also be invoked, subject to the statutory ingredients being satisfied.
In these circumstances, I respectfully request that you may kindly:
1. Register a case/FIR under all appropriate and applicable provisions of law, wherever the ingredients of cognizable offences are found to be satisfied, and initiate a proper investigation;
2. Conduct an immediate preliminary inquiry and forensic examination of the video to identify and record the exact words spoken, the context in which they were spoken, and the intention behind making and publishing such statements;
3. Verify the identity and account details of the person who created and published the video, including the original source account and any associated social media accounts;
4. Take immediate steps, in accordance with law, to preserve and secure the original digital evidence, including the video, URL, account information, metadata, upload details, date and time of publication, and details regarding its circulation and reach;
5. Identify whether the video has been further circulated, reposted, amplified or distributed by other persons, and take appropriate legal action wherever the law so permits;
6. If the investigation establishes that the statements constitute criminal defamation or any other offence for which a complaint before the competent court is legally required, kindly take appropriate action in accordance with the procedure prescribed by law and provide me with the necessary guidance regarding the further legal remedy available;
7. Take all other necessary legal steps against the person responsible for creating and circulating the said content, in accordance with the provisions of the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023, Information Technology Act, 2000 and other applicable laws.
